Welcome to Be Heard Space ("we", "our", or "us"), accessible at beheardspace.com. By accessing our website, creating an account, or booking a listening session, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our service.

Be Heard Space is strictly a peer emotional support platform. We are not a licensed healthcare provider, medical clinic, psychological counselling center, or crisis intervention service.

Our listeners are compassionate individuals trained in active listening, empathy, and conversational support. Listeners do not provide medical diagnoses, psychiatric evaluations, psychological treatment, clinical therapy, or prescription advice.

Participating in a session does not establish a doctor-patient, therapist-client, or healthcare provider relationship. If you require medical care, psychotherapy, psychiatric diagnosis, or clinical support, you must seek guidance from a licensed medical or mental health professional.

Be Heard Space is not equipped to handle medical emergencies or acute psychiatric crises.

If you are experiencing suicidal thoughts, self-harm urges, severe emotional distress, or any life-threatening situation, please contact emergency support services immediately:

• United States & Canada: Call or text 988 to reach the Suicide & Crisis Lifeline, or text HOME to 741741.
• United Kingdom: Call 111 for NHS mental health services or call 116 123 for Samaritans.
• International: Contact your local emergency telephone number or visit an emergency room.

Listeners have the right and ethical duty to terminate any session immediately if a client indicates an imminent risk of harm to themselves or others.

You must be at least 18 years of age to book a session independently. Individuals between 16 and 17 may use the platform only with verifiable parental or legal guardian consent.

When scheduling, you agree to provide an accurate first name, valid email address for delivery of your private Google Meet video link, and legitimate payment information.

Each standard session lasts 30 minutes and is billed at a flat rate of $20 USD.

• Founding Member Rate Lock: If eligible as an early member, your $20 USD session rate remains locked for your first 10 sessions.
• Payment Processing: Payments are processed securely in USD via certified payment gateways (including Stripe, Paystack, and Flutterwave). We never store your full payment card number on our servers.
• Voluntary Tips: You may choose to send a gratuity to your listener following a session via our tip portal. All tips are voluntary gifts, processed in USD, and are non-refundable.

We know that unexpected life events happen. To honor both your schedule and our listeners' reserved time, we maintain the following cancellation terms:

• Rescheduling: You may reschedule your session at no charge up to 2 hours before the scheduled start time using the link in your booking confirmation email or via My Bookings.
• Advance Cancellations: If you cancel your booking at least 2 hours before the scheduled session, you are eligible for a 100% full refund to your original payment method or full session credit.
• Late Cancellations & No-Shows: Cancellations made less than 2 hours before the session start time, or missed sessions where the client does not join within 10 minutes of the start time, are non-refundable. This compensates the assigned listener who kept their schedule reserved exclusively for you.
• Listener Cancellations: In the rare event that a listener cannot attend due to an emergency or technical failure, you will receive an immediate notification, a full refund or a complimentary rescheduled session at your convenience.

Be Heard Space is built on mutual respect, empathy, and psychological safety. During your session and across all interactions on our website, you agree that you will not:

• Engage in harassment, verbal abuse, hate speech, bullying, stalking, or discriminatory remarks toward listeners or staff.
• Display nudity, sexually explicit material, violence, weapons, or illegal activities during video sessions.
• Solicit personal contact details, physical meetings, financial loans, or inappropriate relationships with listeners.
• Record, screenshot, photograph, broadcast, or publicly distribute any part of a video or audio session.
• Attempt to reverse-engineer, exploit, or disrupt the website, backend APIs, or server infrastructure.

Listeners are empowered to disconnect immediately from any session where abusive, threatening, or explicit behavior occurs. Violators will face permanent platform bans without a refund.

We treat your trust with the highest degree of care:

• Zero Platform Recordings: Be Heard Space does not record, archive, or listen in on your Google Meet sessions. What you share in your session stays in your session.
• Strict Confidentiality: Listeners sign legally binding confidentiality agreements and are trained to protect your personal disclosures.
• Legal Exceptions: Confidentiality may only be breached when required by applicable law, such as when there is an immediate, credible threat of severe physical harm or suicide, or when mandated by a lawful court order.

The service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

To the maximum extent permitted by applicable law, Be Heard Space, its founders, operators, employees, and listeners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform or any session interactions.

Our total aggregate liability for all claims related to the service shall not exceed the amount actually paid by you to Be Heard Space during the twelve (12) months preceding the event giving rise to liability.

All trademarks, logos, branding, website designs, editorial articles, custom graphics, and software code on Be Heard Space are the exclusive property of Be Heard Space and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without prior written permission.

We reserve the right to revise or update these Terms at any time. When modifications occur, we will update the "Last updated" date at the top of this document. Continued use of the platform after revised Terms become effective constitutes your binding acceptance of the updated terms.

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to conflict of law principles. Any dispute that cannot be resolved amicably shall be submitted to binding individual arbitration or resolved in the competent courts of Delaware.
